Jomba Safaris – Terms and Conditions

1. Booking and Payment
- A booking is confirmed only upon receipt of a non-refundable deposit of 20% of the total tour cost.
- The balance must be paid in full no later than 14 days prior to the start of the tour.
- Alternatively, clients may pay a 50% deposit and settle the remaining 50% upon arrival.
2. Cancellation Policy
- Cancellations must be made in writing via email or official company contact.
- Cancellation fees are as follows:
- – More than 30 days before departure: Loss of deposit
- – 15–30 days: 50% of total cost
- – Less than 14 days: 100% of total cost
- Refunds will not be given for no-shows or unused portions of the trip.
3. Alterations by the Company
- Jomba Safaris reserves the right to make changes to the itinerary, accommodation, or transport due to unforeseen circumstances (e.g. weather, road conditions, or political issues).
- In such cases, we will make suitable alternatives at no extra cost or offer a refund if the tour is canceled.
4. Client Responsibility
- Clients must carry valid travel documents, including passports, visas, vaccinations, and insurance where applicable.
- It is the responsibility of the client to ensure they are medically fit to participate.
- Clients must adhere to Kenyan laws, customs regulations, and instructions from the tour guide.
5. Insurance
- Comprehensive travel insurance is strongly recommended for all participants.
- Jomba Safaris will not be held liable for injury, loss, theft, or damage to personal belongings.
6. Liability and Indemnity
- Jomba Safaris acts only as an agent for hotels, transport companies, and other service providers.
- The company is not responsible for any loss, injury, or damage sustained during the tour, unless directly caused by the company’s negligence.
- Clients agree to indemnify the company against any claims arising from their actions during the tour.
7. Pricing
- Prices quoted are based on current rates, taxes, and currency exchange.
- The company reserves the right to adjust prices in the event of significant cost increases (e.g. fuel surcharges, park fees, etc.), provided notice is given.
8. Wildlife and Nature
- Sightings of wildlife are not guaranteed due to the unpredictability of nature.
- Clients must follow the instructions of the tour guide and game park rules at all times.
9. Complaints
- Complaints should be reported immediately to the tour leader or office representative to allow for prompt resolution.
- If unresolved, written complaints must be submitted within 7 days after the tour ends.
10. Jurisdiction
- These terms and conditions are governed by the laws of Kenya.
- Any disputes shall be settled in Kenyan courts.
